Taconic Parkway
Some times getting a traffic ticket isn't a big deal. You sign the back, pay a fine and it's over with. However, all too often the guilty plea and fine are only the beginning of a costly experience. In NYS fines for speeding can be $300 or more, plus NYS Dept. of Motor Vehicles can add "responsibility fees" of as much as $525 for accumulating 6 or more "points" on your license. On top of all that damage a traffic ticket can increase your insurance rates for 3 years.

The Taconic Parkway is a beautiful 4 lane divided highway that begins in Westchester County, NY and extends for over 110 miles until it intersects with the NYS Thruway (I-90) in Columbia County, NY. But, the beauty and relaxing nature of a drive on the Taconic can be deceiving. What many driver's don't realize is that the Taconic Parkway is one of the most heavily patrolled roads in NYS. Every year thousands of speeding tickets and other traffic violations are written by NYS troopers all along the length of the Taconic.

For most of the length of the Taconic Parkway traffic law enforcment is handled by units of the NYS police out of "Troop K' in Millbrook, NY. State police troopers use both radar and laser speed detection systems and because of the winding, undulating nature of the road there are many places where the police cannot be seen or detected before its too late to avoid a ticket.

In 2009 the Troop K officers wrote nearly 35,000 speeding tickets and more than half of those were on the Taconic Parkway! They also made nearly 2,500 DWI arrests and more than 4,000 other traffic related arrests. So, if you've received a speeding ticket on the Taconic you are not alone.

Taconic Traffic Courts
There are more than 20 different courts that handle cases generated by police activity along the Taconic Parkway. These are all local town or village courts. How cases are handled in each court differs a great deal. Criminal cases are prosecuted by the District Attorney's office for each county (Westchester, Putnam, Dutchess or Columbia) this includes charges like DWI, Aggravated Unlicensed Operation, Driving With Suspended Registration, etc. Different Assistant District Attorneys are assigned to each court.

Non-criminal traffic violations, like speeding, in Columbia County are also prosecuted by the county DA's office. However, in alll the towns in Westchester, Putnam and Dutchess Counties traffic tickets are prosecuted by local "special prosecutors" hired by the town or by the officer who wrote the ticket. Each of the prosecutors has his/her own policy on speeding, plea bargaining, etc.

Understanding how each court/prosecutor works is key to obtaining the best possible outcome for any charge you are facing. Our firm appears on a regular basis in all of the courts along the Taconic. We know each ofhte prosecutors and judges involved.

Impact of speeding convictions on Out-of-State drivers
 
Many of our clients ask about the impact of a NYS speeding conviction on their home state licenses.  In fact, the impact can be very severe because many states will treat a NYS traffic violation as though it happened in at home.  This means that any NYS speeding conviction may result in "points" back home.  As a result, out-of-statedrivers can have both their license and insurance severely effected by a New York speeding ticket.
Hidden Costs of NYS Traffic Convictions
 
One of the hidden costs of a NYS traffic conviction is a special "driver responsibility fee" imposed by NYS Dept. of Motor Vehicles.  The fee is imposed on any driver (NYS or other) who accumulates 6 or more points in an 18 month period.  This means that a single "6 point" ticket can result in a $300 fee from DMV on top of any fine the court imposes.  The fee increases by $75 for each "point" above 6.

NYS "Cell Phone" tickets now carry "points."
 
NYS DMV has announced that effective February 16, 2011 traffic tickets charging cell phone use while operating a vehicle will now carry "2 points" on the NYS DMV point system.  Previously, these tickets carried a fine, but not points.
